On Wednesday 25th of March, Bamboo Auctions broke yet more records on our platform with a property selling for £5.4 million.

With an original guide price of £800,000, this commercial plot boasting 14.56 acres of land, in Grays, Essex, skyrocketed to success showcasing the strength and the type of properties that can sell at online auctions.

The property was sold by Clive Emson Auctioneers, using Bamboo technology. The success of this auction was demonstrated by the staggering stats; with 113 bids placed by 6 different bidders.

At over 575% above the guide price, this sale is the most expensive lot sold using Bamboo’s technology.

If you are currently in the market for buying property, you may have come across the modern method of auction. Or as we call it, a conditional auction. This method of sale is increasing in popularity and it wouldn’t surprise us if it catches up with the private treaty method.

Need a refresher? Read our post here on the difference between a traditional and a conditional auction.

But why is it the ‘modern method’? How has it evolved from the traditional auctions/methods of sale (like private treaty)? Below are a few reasons why the modern method of auction can improve property transactions. After all, it gives everyone a fast, certain and transparent process. All the makings of a modern property sale.

With the rise of on-demand services, it is the natural progression that you can buy a house at your convenience. Most, if not all conditional auctions happen online. This lets interested individuals bid anytime, anywhere. Whether you are on a boat out sailing in Greece or sitting in bed in your pyjamas on a Friday night, bid away!

Note: We also have partners who utilise a traditional auction online - which sees an immediate exchange when the timer reaches zero. So it’s not limited to conditional auctions. Be aware of which method the property that interests you is being sold by.

In contrast to a traditional auction, you don’t have to be a cash buyer to buy at a conditional auction. The modern method opens up the doors to potential buyers who need to raise finances to purchase. As it is a conditional auction, this gives the buyer 20 days to exchange on the property. This should be enough enough time to get a mortgage arranged.

With a deadline for exchange, it gives everyone a concrete goal to work towards. There is no unnecessary delays as both parties are legally obliged to exchange on a set date. So when compared to private treaty method of sale, it can be faster (and more certain).

Gazumping: Gazumping occurs when a seller accepts a verbal offer on the property from one potential buyer, but then accepts a higher offer from someone else. -Wikipedia

Gazundering: The practice whereby a prospective buyer (especially of property) makes an oral offer (a promise to purchase) on the property at an agreed price but subsequently threatens to withdraw the offer unless the seller agrees to a lower price. -Wikipedia

Yes there are technical terms for people who like to play games when buying/selling property. In a private treaty sale, you can only keep your fingers crossed that the buyer/seller you are dealing with don’t play these games. Nothing is more frustrating than having the deal pulled out from right under your feet at the last minute.

A recent article has found that gazundering is becoming an increasing worry for home sellers. With 45 percent of people concerned about this - up from 40 percent last year.

With a conditional auction, if the reserve has been met at the end of the auction; both buyer and seller enter into a legally binding reservation contract.

The price at which both parties have to exchange is fixed (gazundering)

The seller can’t accept any other offers (gazumping)

When property is ‘sold’ via private treaty, it might be the first reasonable offer that gets to ‘buy’ the property. *Most private treaty sales are actually Sold Subject to Contract. If you are a day late in making your offer, the seller would have already accepted another offer and ‘sold’ the property.

With the modern method, everyone gets a fair chance to make an offer for the property. The auction timer is set to end at a specific time. This gives everyone interested the opportunity to make a bid.

In a nutshell, the modern method of auction is still similar to a traditional auction. But with extra flexibility - something we have come to expect from present day services.

A few reminders if you’re planning on bidding on a conditional auction.

Be prepared with your finances (or at least a plan!).

Sure a conditional auction may not be suitable for everyone. But when it works, it works! It gives both buyer and seller a fast, certain and transparent property transaction.

What makes it the modern method of auction?

Just because a property goes up for auction, doesn’t make it a guaranteed sale.

There may be multiple bids on the lot but if the reserve isn’t met, the seller is under no obligation to sell. Whether it is a traditional (immediate exchange) auction or a conditional (modern method) auction, the conclusion is the same.

Reserve not met = no obligation to exchange/enter into a reservation contact.

So what does happen after a property is unsold at auction?

It all boils down to what the seller is after. If they want to sell the property, there will be scope for negotiation in price. They might be willing to take a lower figure to close the sale. But if they have a minimum price in mind that they want for the property, then it will be harder to get them to change their minds.

One thing to consider is, what type of property is it?

With the property being income-producing, the seller might be happy to hold onto it for a while longer. They could wait until the market has moved in their favour to put the property up for sale again. But of course Section 24 is phasing in which will trigger landlords to reconsider what they hold in their portfolio. Although the property is income producing, the inability to claim finance relief will make it less appealing (depending on the landlord’s individual tax situation).

VACANT RESIDENTIAL OR COMMERCIAL PROPERTY

Properties that are vacant may lead to a more motivated seller. There are costs to owning a vacant property. For example: mortgage, bills, insurance, council tax etc. Empty properties also run the risk of being broken into - which could lead to losses/damages.

If it is a development opportunity (as many auction lots are), the seller may decide to do the works themselves and sell on at a later date.

Rarely have we seen land going unsold at auction. But if it does, ask yourself this question. Has it been on the market for a long time? The seller might be happy to drop the price. If it has recently come onto the market, the seller might take a different route. They could decide to keep it and find another purpose for it (get planning and then later sell it with planning consent).

Many people who look to sell at auction are looking for an efficient sale. So while the reserve isn’t met, that doesn’t mean there isn’t a deal to be done.

Here are some possible scenarios for unsold lots:

A property that is unsold at auction doesn’t mean there are no interested parties. They may decide not to bid during the auction in hopes of putting in a cheeky! after auction offer. Everybody loves to feel like they’ve got a bargain.

When there are multiple after auction offers, the agent/auctioneer may decide to hold a mini-auction. This is much easier to do with an online auction as they just have to relist the property. Read this story of how a property went from unsold - relisted - sold; all in the same day

Auctions are generally considered a good indicator of the true market value of a property. So when a lot goes unsold, the price could be the issue. With clear evidence of bids made/not made, the agent or auctioneer can go back to the seller and persuade them to reconsider the reserve.

Often wiggle room to lower the reserve will help attract more interest. With ballroom auctions, the property with a now lowered reserve can go into the next catalogue (whether that’s a month or two away). Or in the case of our platform, pressing the ‘Relist’ button.

DIFFERENT METHOD OF SALE (PRIVATE TREATY)

The seller might decide to put the property back on the market via private treaty. This is the most common method that is familiar to everyone. The buyer and seller negotiate the price privately. There is no enforceable deadline for an exchange/completion date.

Ultimately every property, seller and auctioneer are different. But we hope that this post has cleared up a little as to what happens with unsold lots. The end of an auction is not the end of the line!

What happens when a property auction ends and the reserve is not met?

What happens when you just can’t find the perfect ‘forever home’? Maybe you’ve looked at a dozen houses there is something not quite right with each one.

Now you think? Well, if I can’t buy my perfect home, why not build it?

It is forecasted that the value of self build and custom build market will grow by 41% by 2020. Source

But of course that doesn’t mean that every person will be building their own home. Here in the UK, the self-build community is a relatively small one. With about 10% of houses in the UK being a self-build. This is in comparison to most of Europe (over 50%) or the USA (around 45%). Source

If you are looking to start your own self-build journey.

Here are 3 questions you have to ask yourself.

No surprise that money should be your first consideration.

Ask yourself honestly, how much do you have to spend?

Are you looking to build a tiny house? Or a large custom home with a basement cinema. For every new feature you want, the cost will go up. There is no ‘motivated seller’ if you are building your own home. You won’t be able to negotiate the cost down from a seller who needs the sale to go through as quickly as possible. Don’t forget to account for delays or unexpected costs (all part and parcel of housing construction). It would be prudent to have at a minimum a 10% buffer in your budget.

If you need a self-build mortgage, you will also need to take into account the monthly mortgage repayments during the build. Self-build mortgages/development finance will have higher interest rates than a typical residential mortgage. This is due to the increased risk the lender takes with the project.

Now that you’ve established the basic build costs, the next question is how? If you are a builder yourself then DIY it is! For those less inclined to laying a brick or plastering, you will need to know how to manage the build.

Building a house is not a quick process. There will many site visits needed to make sure that the process is going smoothly. So if you can’t be on-site constantly, then you will need the help of someone who can.

Hiring a project manager will also increase the cost so do take that into consideration. While you may be inclined to manage it yourself in order to keep the costs down, remember this quote.

If you think it’s expensive to hire a professional to do the job, wait until you hire an amateur.

3. Have you found the location you want to build on?

Last but not least is location, location, location. Self-build plots are not as common so be prepared to do a little more hunting. Auctions are a good place to start. Whether you are looking to buy land and work with a planning consultant/architect to get planning permission from the council or a of land with planning permission already granted; it is quite likely that they will be sold via auction.

There will of course be a difference in the pricing of land that has planning and land that doesn’t. Land with planning may cost more. The seller will want to be compensated for the time and effort they put into seeking planning. While land without planning could appear cheaper, make sure you read the legal pack carefully. There is occasionally an overage clause. This entitles the seller to additional payments from the buyer when certain conditions are met. More often when there is a change of use to the piece of land i.e. from agriculture use to residential.

Then continue down the self-build path! It would be worth investing the time and effort into making your ideal home a reality.

3 questions to ask yourself if you want to self-build

Probate is a term that you might have come upon if you live in England or Wales. This is the term used when dealing with the assets (property, money and any other possessions) of an individual who has passed away. Probate includes any legal or financial aspects of dealing with the deceased’s assets.

Before the beneficiaries of the will can sell/claim/move the deceased’s assets, they will need to wait for grant of probate.

While England and Wales calls it Grant of Probate, in Scotland it goes by Grant of Confirmation.

Make sure there is grant of probate when buying ‘probate’ property. If it has not, then expect the house buying process to be slower as you wait for solicitors to get everything in order. Unless it’s surviving spouse (person) who is a Joint Tenant on property. Then they won’t need grant of probate before selling off the property.

Probate properties are typically offered with vacant possession. This means there is no upward chain. If you’re eager to move in/get started on refurbishment as soon as possible, a probate property gives you the opportunity to do so. There is no need to wait for existing owners to find their own home to buy before moving out.

This is also gives you the option to set your own completion date without holding to the seller’s timeframe. You should be able to move quickly as you may be able to negotiate the exchange and completion date to suit you.

On our online auction platform, there is usually 20 working days to exchange on a property bought through a conditional auction. Completion occurs 10 working days from exchange. Although it is up to the buyer and the seller if they would like a longer or shorter completion period.

If the property is being sold by motivated beneficiaries, they may be willing to discuss the price. They might prefer having cash in the bank instead of holding out for a sale at the ‘perfect price’.

There are also additional costs when holding onto an empty property. The bills for council tax, insurance for an unoccupied house or garden maintenance do add up. All these costs can be significant up the longer the property is unsold. So it might be in their best interests to let the property go as soon as someone makes a reasonable offer.

OPPORTUNITY TO PUT YOUR STAMP ON THE PROPERTY

Love a bit of personalisation? Then buying a probate property is the perfect opportunity to put your own flavour on the home. Many properties up as a probate sale will still have decor from when they were first constructed/purchased. Not a fan of that floral wallpaper or green carpet? Rip it out and install the feature wall and marble tiles of your dreams.

Cosmetic changes aside, it is also important to look at the structure of the property. Due to the age, there may be structural issues that need to the buyer will need to address. If the property has been vacant for a while, do also check for signs of damp.

If there is more than one executor, there may be delays during the exchange/completion process. As they will have to act jointly, getting everyone to sign documents may take a bit longer.

UNABLE TO ANSWER QUESTIONS ABOUT PROPERTY

Some seller(s) may have never lived in the property. So they won’t be able to answer some pre-purchase questions. Of course with the auction legal pack, it can help answer many questions. 

The executor of the estate should look to get the best price possible for the probate property. Selling the property via online auction gives everyone involved the flexibility and certainty needed. Auctions are a great way to show transparency when selling on the open market. This way there is less likely to be a dispute on whether the sale price is fair.

As the saying goes, ‘fail to prepare, prepare to fail’; it is beneficial to have a game plan before bidding on auction property. There is much more to bidding than having the deepest pockets.

Of course having an unlimited amount of funds would guarantee a win. But you’re not here to win at “who spends the most”, you’re here to implement a plan/vision for the house or land that you want, and buying for a good price is critical to that plan.

Whether it’s a ground rent investment, a large piece of land with planning potential or a development opportunity, some auction properties will be more popular than others. In instances like those, it would help to be strategic with how you bid. A well placed/timed bid could stop competing bidders in their tracks.

Everyone has their preferred bidding tactics. But here are some common strategies we have observed.

One large strategically placed bid can help stamp out the competition. It gives the impression that you are not afraid to make your mark. It doesn’t have to be a significantly larger amount above the guide (as you don’t want to be overpaying) but bidding your absolute highest amount does make people think.

You may not want to draw attention to a specific lot but being an early bidder could be advantageous. Make your presence and interest known to other bidders by placing the first bid. Some bidders will not want to get into a bidding war so making an early bid could put others off.

We have even seen a bidder placing a bid at 3am! Probably in hopes that it’ll slip past other interested parties and have a nice quiet win. Of course this is only possible with online auctions since they run 24/7.

A strategy for those with patience (and potentially deep pockets). With many popular auction lots, there can be a flurry of bidding activity at the start of the auction. As the price rises, the number of interested bidders will drop.

This strategy is for those who don’t want to be actively bidding against many other people, but waiting until it’s only a few bidders left. If there is only one bidder left, it may be easier and quicker to win the property. However, you run the risk that the price has risen higher than you’d hoped.

If the property has not met its reserve when the timer reaches zero, it has not sold. There are individuals who are hoping that the reserve isn’t met as they want to do a post-auction deal. With online auctions, it’s less likely that this will happen, so don’t wait - bid!

Bear in mind the differences between starting prices, guide prices and reserves - the reserve cannot be more than 10% above the guide price, so that should give you a good indication of the sellers price expectations.

Seasoned auction goers might change tactics depending on the popularity of the lot and what fellow bidders are doing. Coming up with a plan before placing a bid is crucial to keeping your head clear.
